4. The State of Tennessee To the Sheriff of Sevier County Greeting Whereas S.O. Dickey has filed in the Chancery Court at Sevierville his Bill of complaint, stating among other things that a certain John S. McNutt about the 10th day of May 1860 became indebted to complainant the said S.O. Dickey in the sum of $1150.00 for the payment of $1000.00 of which the said John S. McNutt on that day executed his promisory note due and payable one day after date and for the remainder of said sum, he executed his other promisary note due and payable on or before the 1st day of September 1860 for the sum of $150.00. On one of their notes there has been paid only the sum of $26, and all the remainder of said sums are due and unpaid together with the interest thereon. The said payments are endorsed on said notes one of $10 made 1st day of May 1864, the other 1st day of October 1864 by Mrs. Hodsdan, of $16 making the said sum of $26, and he further states that the said John S. McNutt has absconded and gone beyond the limits of this State so that the ordinary process of law cannot be served on him. And the said complainant, S.O. Dickey prays in his said Bill that an attachment issue and be levied on the lands of said defendant McNutt to secure complainant's said debt and costs of suit which is granted by the fiat of his Honor E. T. Hall one of the judges of the Circuit Court for East Tennessee. You the Sheriff of Sevier County are hereby commanded to levy this attachment on the lands of Defendant John S. McNutt and make return how you shall have executed this writ, at our next Chancery Court to be held at the Courthouse in Sevierville on the third Monday of March next. Witness R.
