REGULATIONS CONCERNING ALIENS AND VETERANS

The Emergency Relief Appropriation Act of 1937 contains the following provisions: 

“Sec. 3. The departments, agencies, or establishments having supervision of projects for which funds from the foregoing appropriation are made available shall not knowingly employ on such projects aliens illegally within the limits of the United States or aliens who have not filled the declaration of intention to become citizens and they shall make every reasonable effort consistent with prompt employment of the destitute unemployed to see that such aliens are not employed, and if employed and their status as such alien is disclosed they shall thereupon be discharged: Provided, That preference shall be given to American citizens who are in need of relief in employment by the Works Program Administration and next those aliens who are in need of relief and who have declared their intention to become citizens prior to the enactment of this joint resolution: Provided further, That veterans of the World War and Spanish War who are in need of relief shall be given preference for employment by the Works Progress Administration.

“Sec. 12. Any person who knowingly and with intent to defraud the United States makes any false statement in connection with any application for employment, or relief aid under the foregoing appropriation,........ shall be deemed guilty of a misdemeanor and fined not more than $2,000 or imprisoned not more than one year, or both.”

In order to comply with these provisions, the following regulations are established:

1. All employees of Federal Project #1 will be required to make a statement regarding citizenship. Mimeographed forms will be distributed, to be returned by the employee to the Project Employment Officer not later than July 12, 1937. Failure to return a statement will be construed as lack of citizenship as defined above and a Notice of Dismissal will be issued effective July 15th. A Notice of Dismissal so issued may be rescinded upon receipt of the required statement, not later than July 15, 1937.

2. All veterans as defined above who have been dismissed may apply immediately to the Project Employment Officer for reinstatement, except where the dismissal has been for cause.
