[2] WILLIAM MACHETH, being duly sworn, says: I reside at 834 Prospect Place in the Borough of Brooklyn, City of New York, and am one of the persons named as an executor in the paper writing purporting to be the Last Will and Testament of Henry W. Ranger, late of the City of New York, deceased, propounded for probate and now pending in the Court of Surrogate in the County of New York; the other person named as executor therein in Charlee Henry Phelps, residing at 412 West End Avenue in the Borough of Manhattan, City of New York, whose affidavit is annexed hereto.

[3] By the said Will, the wife of said testator was given the entire net income of the estate for life, after the payment of debts and funeral expenses, and after her death the entire property of the estate was given to the National Academy of Design, an art institution in the City of New York, duly incorporated under the laws of this State. The testator's wife predeceased him, so that according to the provisions of said Will if probated, the entire estate will belong to the National Academy of Design.

The proof of said Will is contested by Edith F. Ranger, a sister of deceased, who resides at 311 West 55th Street in the Borough of Manhattan, City of New York, and
