JOHN P. EAST, being duly sworn, says: I am attorney for William Macbeth and Charles Henry Phelps, proponents herein, upon whose petition a citation in the above-entitled proceeding was issued out of this Court, returnable November 28, 1916, and directed to the next of kin of the above-named decedent. On the return day of said citation, Edith F. Ranger, the sister and sole next of kin of the decedent, filed a Notice of Appearance by her attorney, James C. McEachen, Esq., who, in her behalf, also filed an answer setting forth formal objections to the probate of the paper writing propounded as the Last Will and Testament of Henry W. Ranger, deceased, and in said answer demanded a jury trial of all the issues raised by the petition and the answer. More than five (5) days have elapsed since the said objections were filed, and the said Edith F. Ranger, the contestant, has not presented nor given Notice of Settlement of a proposed order and directing trial by jury and plainly and concisely stating the controverted questions of fact to be tried by the jury. In view of the default of the contestant in this respect and pursuant to the rules and practice of this court, in behalf of the proponents I am causing to be served herewith upon the attorney for the contestant a
