Personally appeared before me this 16th day of January 1867. Samuel Ellison and having been duly sworn testifies as follows.

My name is Samuel Ellison - I live in Robertson County, 10th district, Tenn about three miles from Cross plains on the White hill road. My wife Eliza Jane Ellison was killed by a pistol shot by Dr L.B. Walton living in Cross plains Robertson Co Tenn. The facts are as follows. My wife Eliza Jane Ellison had a little argument with Mrs L.B. Walton, about washing some clothes. My wife asked Mrs Walton who would pay her for washing extra clothes and which she was not bound to do by her contract. Mrs Walton said she should do it. During the argument Dr  Walton came in and abused my wife for as he said insulting his wife, which she did not do. He (Dr Walton), then left the house. On the 12th day of December 1866 Dr Walton came to the house where my wife was working. after some further argument Dr Walton said shut up you God damn bitch I will learn you something and saying at same time get off my premises.
