Before me personally appeared the undersigned Thomas Moseby and being duly sworn deposes as follows.

My name is Thomas Moseby.  I live in the City of Memphis Tenn. and I am a discharged soldier.
On the 2 of May 1866 Pat Pendergrass John Pendergrass Bill Callahan and two Policemen and a number of other men (subsequently advised that Cash was in the party) came to my house broke into my bank and took from it $60.00 in "greenbacks" and a watch worth $35.00  I jumped out of the window and ran under the house.
They then left my house and got after another man and came back.  Said that man ran into my house & said I was the man and took and me.  Several of them drew their guns and revolvers on me. Callahan wanted to kill me anyhow.  The two Pendergrass's stopped him and said "don't kill him he is a good boy" and one of the best neighbors we have."
