Before me personally appeared the undersigned, Henry Porter, and being duly sworn deposes as follows.
My name is Henry Porter, I live in South Memphis, on the 2nd of May 1866, I saw a number of armed men drinking at Mr. Pendergrasses store - I went there, and he (Pendergrass) told me they were shooting, but would not hurt me. On Wednesday 3rd of May before day light I saw the old man Pendergrass set fire to the house in my neighborhood. As they fired the last house, an old woman colored, came out when both the father and son, fired and shot a girl, in the mouth who fell into the fire and was burnt. The old woman and children escaped. The Pendergrasses, walked around until the building was consumed. apparently guarding the building
