Before me personally appeared the undersigned Penny Le Mier and being duly sworn deposes as follows:
My name is Penny Le Mier I live on Raylom Avenue, South of South of Street. On the 1st day of May 1866, I was standing at my door and saw John Pendergrass pass with a pistol in his hand. I followed him and saw him go up to a colored soldier and shoot him - killing him - do not hav his name. The colored soldier was walking along quietly. I then saw Corpl John Robinson (cold) running with two white men after him, some one said there comes another one of the dam rascals, when Pendergrass turned around and met Robinson and shot him. Robinson fell and Pendergrass beat him over the head with his pistol. Pendergrass then left and I went up to Robinson and found him dead
