Samuel A Burns testifies under oath that he is a Policeman, that on the evening of the 28th of June last he was walking his rounds and was attracted to the Corner of Trade and Tryon Sts by an unusual noise and loud swearing. he there found some of the policemen endeavoring to persuade a man to go home, but he violently resisted them, defying them to arrest him, using the most profane and vulgar language, we were compelled to arrest him, in taking him to the jail, he struck me, and his conduct was of the most abusive and violent nature. He told us, after we tried to persuade him to go home, "I dare you to arrest me God damn You" repeating the oath, many times. I did not know he was an officer of the government, for he was dressed in citizens clothes, but he asserted that he was Bvt Col, Geo R Bell, V.R.C and a cousin of President Andrew Johnson."
