Respectfully referred to Mr. J. R. Webster, Sub-Asst. Comr., &c., Bolivar Court House, Bolivar County, Miss., as coming within his district and jurisdiction.

In this case Maj. Ryan, late Sub-Asst. Com. of this Sub-Dist., issued an order to Mr. Berry, directing him to deliver up the children to their mother, and an answer was received from Mr. Berry, dated Aug. 15, (which you will find enclosed,) stating that the children would not go with their mother, and that he did not wish to force them to leave. That letter was received during Maj. Ryan's illness when it was impossible for him to take further immediate action.

A letter from Mr. Chas. R Riggs, dated Sept. 8, and received today, states that Mr. Berry has not and will not deliver up the children to their mother. I have just issued another order to Mr. Berry, directing him to carry out the former order, and informing
