| May 28" 1866. 138 | Harris Elizabeth | Buckingham Co. Va. May 26" 1866. States that she is a colored woman and formerly belonged to John S. Harris, a resident of Va. and Miss. who by his will left $67.020 to herself and 7 children she had borne him: the will was admitted to probate in the Probate Court of Bolivar Co. Miss. but was afterwards taken to the Court of Errors and Appeals, which reversed the former decision and pronounced the will null and void. Appeals for redress and protection. | May 29" 1866. Respectfully referred to the Asst. Com'r of Va. who will please furnish this office with any information he can obtained touching this case. (sd) A.P.K. July 18" 1866. Rec^d back with report of Capt W. L. Tidball, Asst. Supt. &c. July 21" 1866. Respectfully returned to Mrs Elizabeth Harris (thro Asst. Com'r of Va.) After a thorough examination of the case it does not appear that the Com'r of this Bureau can interfere to secure the claim presented by Mrs. Harris. It was adjudicated prior to the war and when the laws of the State regarding property were in full force & effect. Even if Mrs Harris could prove the last will and testament under which she claims the property it will be remembered that by the laws of Mississippi in force up to the commencement of the War a slave was not permitted to inherit property even when bequeathed by will. unjust as the law was, it was nevertheless the law and was not affected or annulled by the Statutes of the United States up to that time. Does not remember of borrowing money from Mr. "H". regrets that he did not the unpaid bill more attention, promises that he will do the best he can to comfort Mr. H, bearing in mind he has to live and meet other obligations.
