have been filled by an officer who had power to act, and who could be held responcible for his acts; and further that when I represented to Genl Gregory that the good of the Division required that such officer be appointed and urged the matter upon his attention he disregarded the same and failed to appoint such officer.

Charge 2d - Willful missrepresentation - in representing that the claims for State Bounty filed by the Bureau, for colored claimants, were sure to be collected by the Bureau free of charge to the claimants, when he well knew that such was impossible under the circumstances, as a law existed prohibiting the payment of such claims to the Bureau as attorneys, and that Genl Gregory persisted in making such representations when by so doing he deprived the men of the chances of obtaining such bounties through the recognized channels, and ultimately resulting in the entire loss of the same except by selling out to swindlers for a mere song, and that in one instance where a man presented his Bureau receipt and asked for his discharge and said the Comptroller had promised him his bounty in person upon presenting the same, as he had done a friend of his a day or two before, Genl. Gregory, virtually refused to return the said Discharge, by making the most profuse and positive assurances that his bounty would be collected through the Bureau and that it would be much
