this charge will be found in the testimony of James Bruce, (Vol 1 Pg 8 L6 to 10) Mrs Eliza Wallace (Vol 1 Pg 31 L 5 to 10)

Considering the fact that James Bruce was the principal consumer of whisky, that two witnesses, testify that they would not believe Mrs Wallace under oath - (See Vol 2. Pg 14 & 19) and that Gen'l Ely Testifies that Roberts' character for sobriety is good, Vol 2 Pg L ) and Lieut Burnett that he Knows he is sober, (Vol 2  Pg 12 L 16) and Lieut Brown, that his character for sobriety is excellent, (Vol 2 Pg 31. L25)

I conclude that Maj Roberts would not steal whisky, and it is useless to waste time on this charge,

Charge Sixth 
That "Maj Roberts is incompetent to fill his position"

Maj Roberts was placed in his present position, by officers who were competent to judge of his qualifications, and is retained there by officers who are not slow to remove incompetent person. I consider this
