This report made March 26th 1867, see vol 1 Pp 48. Line 5) I see in this evidence, but two points worthy of comment. 1st several of the witnesses testify that Dr Bell was in charge. The fact that Gentlemen testify to facts which are a matter of record, does in no wise strengthen their testimony. 2ondly it would appear from the testimony of E.D. Kennedy, one of the signers of the petition and Lt. A.B. Brown who seems to have been intimate with the parties, that the prime movers in this prosecution were aware that Dr Bell was not in charge of the Hospl. nor responsible. 

Dr. R.A. Bell
On the contrary  the defense shows as follows. Dr. R.A. Bell testifies that the Rebel Cadets were employed by order of Dr F.L. Town, in support of which assertion he files the original orders, and that but one Cadet was retained after Dr Bell came in charge of the Hospital viz. MW Roberts, who took the test oath
