I have the honor to acknowledge your letter of this date, and to state in reply that the names of the witnesses I propose are 
1st Capt Gustavus Meiser, late of 29 N.Y.V., now a patient in the hospital for Refugees Freedmen &c at this place 
2nd Dr. B.R.S. Boemond, late acting Asst Surg. in said Hospital, and now acting Asst Surgn. U.S.A.

I purpose to rest the case on the evidence of these two gent'n. and not to adduce other witnesses unless to rebut contrary testimony
