went out & was out but a short time & returned supposes he went no further than the fence which was but a very short distance from the door.—

Cross Examined.
Witness had a pallet on the floor before the fire, sat up until about 12 O.Clock slept his nap out woke & got up two hours before day some one called Mitchell but once he rose & went out came back & went to bed [[Makala?]] was called up but one time during the night by a woman to make up the light. Witness is at work at station No. 2. cant tell what time it was when Mitchell was called out. Mitchell does not work about where witness does & dont know where he does work, dont know what woman it was that called Mitchell up to make a light, she called up Mitchell but one time that Witness knew of, Mitchell said that night that he was sick. Mitchell was there when Witness went to sleep, & when he woke up, Witness called at Mitchells house at dusk. Mitchell looked poorly never saw Mitchell from that day until now. Mitchell was in bed when I went there Witness has been working all about.—

Witness knows Mitchell Cliett. Knows about the Smoke house being broken it was on sunday night. He saw Mitchell on that night, some one called Mitchell out of his house that night, does not know who it was that called him out, He was out about four or five
