Dear Mr. McKenna

I am writing in reference to the Donald Judd sculpture that you had recently in your museum for consideration. According to our instructions you sent them to the Washington Gallery of Modern Art rather than returning them to this gallery.

I received a call from the Washington Gallery, when the work arrived, informing me that some damage had occurred. Donald Judd recently went to Washington to help install some of his works there including the work in question. He told me that one of the fours boxes appears either to have been dropped or to have had something dropped on it. One corner seam is split open and the split runs on to the face of the work. The whole box is warped so that the plexiglass piece no longer fits. This box (one of four) cannot be repaired. A new one will have to be made. Therefore I am writing to you to initiate insurance procedings.

I want to add one more thing which is that this work had been committed to the Washington exhibition and had to be shown even in its damaged condition. Therefore, should insurance investigators ask, it had to be removed from the crate.

I look forward to hearing from you soon in regard to this matter.

Sincerely,

Kay Bearman
