DAMAGE TO DONALD JUDD SCULPTURE

In accordance with our telephone conversation of October 19, 1967, we are confirming the fact that we have now effected the necessary inspection of the damaged portion of the entire art creation by Donald Judd entitled: "Untitled 1966."

As previously discussed, the one unit of the four units making up the total art creation is definitely damaged in the area of the aluminum or stainless steel sheets. However, we noted that there does not seem to be any damage involving the two plexi glass signs involved.

We understand that a $4,000 selling price was assigned to this art creation by Castelli Galleries which price would undoubtedly include the Gallery's sales commission of approximately 1/3 of the anticipated selling price. In order to arrive at a fair and equitable settlement figure in connection with the restoration of the damaged unit, we would appreciate your consulting with the artist involved and obtaining specifics relative to the actual expenditure of monies for labor and material in connection with the necessary restoration taking into consideration at the same time the fact that the plexi glass sides do not seem to be involved.

We shall hold our file in abeyance pending word from you relative to a restoration figure which would be more realistic than the present asking price of $1,000 based upon the fact that $1,000 represents 1/4th of the entire value the piece.
