and allowed throughout the Valley, known to Col. Eaton by which much larger quantities of Government rations were drawn from the regular Commissionaries of Subsistence than was just. That is false returns were made of the number of freedmen at various camps by officers in charge of said camps and frequently two or three times the proper number of rations drawn. In issuing the rations to the freedmen, not more than 1/3d of the regular rations authorized by the Government would be given out. The balance on hand was disposed of in various ways; was generally sold to citizens and proceeds of sales wrongfully appropriated by Officers of the Freedmen Dept. By this manner of dishonest, illegal and cruel proceeding, the Government was defrauded of large sums of money which passed into the hands of Col. Eaton, and the most horrible suffering among the freedmen was the result.

Charge 7th Retention of subordinate Officers and enlisted men by Col. Eaton after their guilt was known to him & neglecting & refusing to remove them, or to cause them to be arrested and Court martialed, & when officers were arrested & were likely to be tried by Court Martial and a thorough investigation of their conduct had, a desire on Col. Eatons part to prevent examinations into freedmens affairs — hurrying such Officers out of the service, causing their resignations to be accepted and getting them out of the way — fearing as has been averred that his own guilt and complicity would be exposed to the world.
