John Henry Peale, being duly sworn, states that - on the 13th inst, while at the residence of his former master Wm. Tucker, near Birdsville, A.A. County Md, he was violently, assaulted and beaten by the said Wm. Tucker and his son Benj Tucker.
   
That while he was conversing with one of the colored people there, Benj. Tucker came along and ordered him to leave the place; that he started to do so when the said Benj. Tucker, struck him over the head, shoulders, & body, several times, with a stick of wood nearly large as a mans arm.  That he kept on & left the place as fast as he could; that after he was off the premises, the said Wm Tucker set the dogs - three in number - on him; that Benj. Tucker ordered him to stop, threatened to shoot him if he did not do so, & immediately fired upon him, with a revolver.  That he then stopped, when the said Benj. Tucker came up, and placing the revolver in close proximity to his head, remarked, "You damned son of a bitch, I have a good mind to blow your brains out."
