whipt that night as witness knows of he was up and down nearly all night & was at Mr. Sims house 3 times to see about a Sheet & during all that time the boy Simon had not been taken off & whipt. Mr. Statham was in his house all the while until he went to bed. Saw Mr. Ennis & Mr. McGrady there that night - if any body had come & taken Simon off that night he would have known it.

Cross Examined
Saw Simon every time he passed & looked in there room, light in the house  thinks he saw him as late as 2 or 3 oclock. also at 10 or eleven he saw Simon & the chain. Simon has a bad character in the neighborhood and from his character he would not believe him on his oath

Green Perry sworn for the Deft. Says he lives with Mr. Henry Sims near Mr. Statham, was at Mr Sims last Saturday
