James Fitzpatrick being duly sworn deposes and says that he knew that Capt. Hill was in the wood business because he bought two cords of wood of him at his office and paid him for it at his office that Capt. Hill gave him half a cord for copying some papers — that on several occasions he was in Capt. Hills office when he heard Capt. Hill asked his clerk (Martin) that if anything important came in the mail he should send it to Patterson & McGrath's or to the wood yard — that to the best of his recollection, colored people came to Capt. Hills office to see him and was told by Mr. Martin or the orderly that Capt. Hill would not be in again that day & they must call the next morning — thinks that he heard such an order given ten or twelve times — always to the clerk or orderly — Sometimes he left
