Oct 20th Recd back with Report EB p575. Vol 5 Nov. 11th EB Vol 6 p.20. Nov 20 EB Vol.6 p. 31 | Washington D.C. Oct 16th 1869 Forwards rept of Bt Lieut Col Geo W Gile Supt of Education for Fla in regard to the enclosed claim of Dr. A D Benedict for damages amounting to $1876 to his property at Magnolia, Fla. while occupied by the Bureau. Stating that the property was during the war alternately occupied by the Union and Rebel troops, at the close of the war the property was used as quarters for troops, and in 1866, was rented by the Bureau at $200 per month for a hospital for Freedmen, that the claim was put in before by Dr Benedict and referred by him (Col Gile) to Lieut Logan Dept Q.M. who did not return the papers but stated that the property had been benefitted instead of injured as a wharf some hundreds of feet long had been erected, that he has no knowledge of the amount of damage done beyond ordinary wear and tear. States that Dr. Benedict encloses vouchers and a letter from Col. J.T. Sprague, formerly Asst Commissioner for Florida, to support his claim. If his statements are true, he is equitably entitled to compensation, but with the value of the improvements deducted. That the Treasury Department does not pay claims for damages and suggests that the amount necessary to repair the building to its condition when first occupied by the Bureau (reasonable wear and tear excepted) be ascertained and paid on the recommendation of the Commissioner. |
