I have the honor to state that after investigation I find the amount due from Irby & Bonsall to freedmen for labor last year to be the sum of $217.36 which amount, less $29.05 paid by an order to McCowan you are directed to pay over forthwith to the undersigned, for and on account of the several freedmen
If as an executor of said Irby, you have funds which came into your hands by reason of said Irbys selling any portion of the crop belonging to the freedmen, you are at liberty to take the same, as it never was assets belonging to the estate.

I have the honor to state that during last year, freedmen Jake Pearce & others worked for Alexander Copeland, but before the expiration of that year Copeland died and the plantation came under the control of George Herndon Administrator &c. Herndon sold the freedmen part of the crop & made an unfair settlement with them. On complaint of the freedmen I caused Herndon to make a new settlement with them at this office on the 18th inst and it was then mutually agreed that the Estate &c had funds belonging to the Freedmen in the sum of $295.18 which amount I directed Mr Herndon to immediately pay over to the freedmen, to which he assented saying that he would go to the Bank & procure the money and return. Herndon did return, but refused to pay over the money on the ground that Judge Wm. H. Sims, (Judge of Probate) had advised him not to, but to compel the freedmen to probate their claims—
The freedmen worked for a share of the crop Herndon had no right to sell their portion, and the funds never did belong to the estate.
I would respectfully request, if consistent with your views, that Herndon be directed to immediately pay over these funds, and also that Judge Sims be directed in the future not to interfere in similar cases.
