S 235 Captain, In answer to your communication of the 25. ult. I am directed by General Reynolds to say in answer to the first question propounded that no specific directions can be given that will cover all cases. In a case such as supposed, the Agent must investigate the matter and decide what is right between the parties. Impose no fines for breaching of contracts by way of punishment, but if the parties, having contracted, earnest agreed as to the continence of said contract the agent must decide what is just between them, and that decision he will enforce so far as to compensate the freedman for labor performed. The employer should agree to furnish the freedman his portion of the crop when matured. The agent must compromise such cases between the parties as there is no law precisely covering them. He cannot oblige men to live together who have disagreed. Agents can fine individuals for assault to the extent of the power granted a Justice of the Peace for same offence, but all such cases had better be referred to a justice of the Peace. If he fails to do his duty fairly, report him with evidence to these Head quarters. As to the manner of collecting fines, the laws of the state must determine - hence such cases had better be taken to a Justice of the Peace. I am directed by General Reynolds to say that you will probably remain at the Post of Tyler indefinitely. There is nothing not indicating your removal. Commissioner &c Washington D.C. 643/649 General, I have the honor to enclose herewith copy of a letter from Hon. Mr. Talbot a member of the Convention. Also copy of an order offering a reward for conviction of incendiaries - I have no direct authority to offer this reward but it is believed to be the best course to put a stop to such lawless acts. I respectfully request that this order be approved and the fund designated from which, in case it is complied with, the payment shall be made.
