In reply to your communication of the 31st ult. I am directed by the Asst. Commissioner to say that the only recourse the men have is the Civil Law of the State.

Failing to secure payment in that way they can apply to the Commanding Officer, Fifth Military District.

I have the honor to return herewith letter from Capt. J.R. Stewart 15th Infty Comdg. Post of Huntsville, making statements in reference to W.H. Howard, late S.A. Comr at Huntsville. Mr. Howard is now in Austin. His reply is inclosed. It is not apparent that any good will result to the service or the colored people from an investigation of this matter now. 

I invite attention to enclosed copy of letter from this office, to Mr. Howard, dated Sept. 21, 1868, referring to balance due on a church belonging to freed people at Huntsville. Also to enclosed telegram by Mr. Howard, stating that said church had been sold. 

No answer was received from Mr. Howard to the letter of Sept 21. placing the indebtedness in a shape to be paid.

I would respectfully recommend that Capt. Stewart be directed to annul the sale and forward the information called for in letter of Sept. 21, 1868, so that the claim against the church (also school house) may be paid by this Bureau. 

Copy of letter from Wm. H. Sinclair, Inspector dated Nov 19, 1868. referring to same indebtedness, is enclosed for information of Capt. Stewart.

In reply to your communication of the 24th ult. I have the honor to state that I have consulted with Lieut Nesmith regarding the check for #52 1/2 sent to Capt Bradford. The check has been returned to Lieut. Nesmith who has cancelled the same, and taken up the money upon his account current. He states that the proper manner for you to obtain the amount due you is to apply to Bvt. Maj. S.T. Cushing, Chief Commissary of Subsistence, Fifth Military District, who will forward the same to the Commissary General of Subsistence. In making the application it is necessary that you procure affidavits of competent witnesses to the effect that the rations furnished were unfit for use.
