Dr Sir:

I am in receipt of your order - (or rather copy of it) that Capt Devine sub A. Comr at this place.  Enclosed I hand you the memo of amenmant entered into with me by freedman William Pitman of AATO 16th Jany 1867 - It is due to say that before Capt Devine was aware of all the facts in the case he gave Dr. Kithell an order for the freedman - but afterwards in coming to acknowledge of all the facts he rescinded that order & gave me one Dr. Kithell under my contract. From this last order Dr. K. appealed to you. Believing that you may have disapproved of the appeal without a full knowledge of all the facts - I write this - urging that it is due me to hear all the testimony in the case before disposing of the appeal. Capt Devine upon a full hearing of the testimony which I would be please to conduct before you, gave me an order for the freedman as
