On his earnest request he was allowed a short time in which procure the money.  He improved it by going to Capt Smiths Camp, who soon after came to me and stated that the matter had now been brought to his official notice, that Mr McGary had come to him for protection, that he would take charge of him, and report the case to Genl. Wright for instructions.  I claimed jurisdiction and refused to turn the case over to Capt Smith.  he then refused to furnish a guard to support me or enable me to take any further action.  Of course McGary encouraged by this course and by the knowledge that I am powerless to enforce my fine has refused to pay it and is now at large.
