stock & property put in his charge & return the same to the said B.F. Harper at the end of the year 1866 & the said Nelson to agree if I shall be in debt to the said B.F. Harper at the dividing of the crop my portion of the crop shall be held by the said B.F. Harper as security untill all liabilitys are paid which is hereinafter mentioned to be one half of all so raised on said plantation by said Nelson & those [[strikethrough]] [[?]] [[/strikethrough]] [[?]] who may work under him & if I the said Nelson fail to carry out my part of this contract in good faith abandon the crop before it is completed housed &c and divided each one of the parties taking his share then & in that case the said Nelson not to receive any compensation whatever for his or their services it is further agreed that in consideration of the labor & services so rendered by the said Nelson & those under him he shall be entitled & receive one half of the crop so raised & for the consideration above mentioned the said B.F. Harper is to have the other half. It is further agreed that if either parties fails or refuses to comply with the above contract on the complaint of the parties required it shall be left to two or more white men to assess the damage & the same shall be paid by the other partie.
