from Lt. A A. Metzner Sub Asst Comr at San Augustine dated at Alto, that a negro had been assulted at a farm near Alto Cherokee Co - and that the party said to have committed the assault resided in this County. I at once called upon some of the officers here, & proceeded to arrest the man which I did and handed him over to the Civil Authorities of Cherokee Co he was tried before a justice of the peace in my presence and acquitted, as from the evidence aduced he was not the man who committed the assult, but that it was done by another Freedman who was hired to this White man; The Freedman who committed the act has so far evaded justice. I have used every endeavour to have him taken but so far have been unsuccessfull -
