Police and that my object was at first mainly to show to all concerned that all persons in my service would be protected; and that if Zall wd. satisfy the negro, I did not care how, I would make the case as light as I could legally do for all concerned. He asked what wd. satisfy the negro and I answered that I had not conferred with him, & did not know, but that he must be satisfied & that he had better notify Zall when he said he wd. do so, if he saw him, but that he "had no idea that he wd. do anything, and that he would be a damned fool if he did. Thus we parted and I came directly on board steamer Bay City, on a tour to Brazos river, to select a route for the Pacific Railway, and for other purposes, and have been caught today (Sept. 28th), at San Luis Pass by a Norther & write this there altho it is dated at Galveston on Saturday. On my suggestion to the Recorder that I might not return until Tuesday, he promised to continue the case of Zall until Wednesday, but as I have no hope of being able to leave here in time to meet the court at 8 a.m. tomorro, I may find on my return that Zall has been acquitted, and myself taxed with the costs.

P.S. Tuesday, 3 P.M. Sept. 25. 1866. After the release of the negro, by legal advisement, I called on the Jailer for a copy of his commitment & was answered that there was none, & that the negro was put into a cell of which the City Marshall  Westerbye kept the key. I then demanded of the Sheriff to be informed in writing how that man was placed in a prison under his charge & was referred to Marshall Westerbye who said they never waited for warrant or order for commitment, and who declined to give me a written statement that was no written authority to imprison the negro. It transpired during this discussion that, by contract of the Sheriff, the Jailor feeds (or is paid for not feeding) the prisoner shut up by the City officials, & that he had given Green his supper but no breakfast.
My Boatman has just refused to set out & I cannot reach Galveston before tomorrow night. Respy.
