by the uppermost suerte of the upper labor, belonging to the heirs of Anastacia Zambrans, said tract lying immediately in the fork of the upper labor ditch and the San Antonio river, and comprising seventy-five acres more or less, Together with all and singular the rights members, hereditaments and appurtenances, to the same belonging or anywise incident or appertaining to have and to hold all and singular the premises above described unto said Confederate States and their assigns forever. Provided nevertheless that said Confederate States or assigns shall in no manner obstruct the rights of owners of irrigable lots on said ditch, below the tract of land herein conveyed.
