innocent party & acted honestly in a transaction within the scope of our legitimate business, should be the sufferers through any contract that Mr Underwood might have had with Freedmen even if that were true, as we certainly had no opportunity of being acquainted with such claims;—neither have we anything to do with them & do not know Mr Underwood or Freedmen in the transaction, having only had dealings with Mann & McMorries who as security duly gave us the proper Press order where the Cotton was & is now stored;
We would therefore ask that the 40 Bales (alluded to & all belonging to the same lot) may also be seized until is is ascertained how much (if anything) is due the Freedmen, & after their claims are settled either the $2500. we advanced should be returned to us or else the 29 Bales released to us for shipment.—
