over the fence and walked away.  Mr. Carter told him he did not wish any difficulty.  Mr. Carter and Mr. Edwards were in Co partnership.  I have known Mr. Carter ever since I knew anybody.  Mr. Carter is a peaceable man also a very timid man. I am of opinion that Mr. Carter was afraid of Mr. Edwards.  Mr. Edwards made to threats toward Mr. Carter in my presence.

W.E. Richards sworn on the part of the defendent sayeth: I was in the house when Mr. Edwards came to the gate.  I went to him at the gate.  Mr. Carter spoke to Mr. Edwards in a calm way, and asked him not to come in his house after threatening me as you have.  He remarked he came for no difficulty and cursed Mr. Carter and told him he was not afraid of him.  He told him 3 times not to come in the house.  Mr. Edwards advanced swearing and had his hand on his side.  At the time I saw Mr. Edwards fall, I saw Mr. Edwards pistol after it was taken from the scabbard after it was dead.  I did not hear Mr. Edwards threaten to kill Mr. Carter.  Mr. Edwards was 2 or 3 steps inside the gate when I spoke to him, and when Mr. Carter spoke also.  I saw Mr. Carter as he left, and not again until this morning Mr. Carter was gone 8 days.
