immediately arrest them. The sheriff summoned a posse comitatus of 4 men, but Milstead & his gang were upon the watch for a surprise &leaping upon their horses, they bade the sheriff and his posse defiance. 
Peter Milstead is a man of little or no property, and has quite a number of friends, & it will be no easy matter to secure him. In this post=oak county, a man acquainted with the county like Milstead & well mounted can safely defy a regiment. There are plenty of white men who will give timely warning upon the slightest suspicion that an arrest with be attempted.)
I have not complied with that part of the Gen. Order No. 5 herein before mentioned, which requires that a statement be sent to the nearest post commander.
