would be to file the affidavit of Freedman Perkins, with regards to the assault, with intent to kill, by his former master, Citizen Darwin, abetted by one Citizen Stracer, both parties residents of Grimes Co. Texas; with the U.S. District Attorney, for the prosecution of the said parties, on the proper indictments.

The fact of a counter charge of similar purport, on the part of Citizen Darwin, does not affect the mode of procedure indicated; but can be taken cognizance of by the U.S. District Court at the proper time, and in accordance with the rules, governing such charges in ordinary Civil Courts.

The papers in this case, with a copy of this letter, have been this day forwarded to the Commanding General, Department of the Gulf, and the man Perkins will be retained by your Bureau, until this reference is heard from, at which time, final instructions will be given you, as to action required.
