2. Copy of an order, signed by A.A. Genl. Wm H Sinclair_. You observe the tenor_. He directs the Sub. Comr - Philip Howard "if you think the boy confined for attempting to commit a rape is unjustly held and there is no good grounds, for the action of the Civil Courts in the case, take it out of their hands, and try it yourself"_. The latitude, given in this instruction, to Mr Philip Howard, is excessively broad - and subject the Courts of the County to his contempt- & enable him to relieve the offender, whither he be guilty or not_.

Copy of an order, signed by Philip Howard directed, to the Sheriff of the County. who had the indicted party in custody_ It is recited in said order, that the demand for the delivery of the prisoner is "in accordance to orders from Bret Mal Genl. J. B. Kiddo"_ The delivery was made in accordance with the demand_.
