hood, that he did not promise, at the same time coming out of the Cabin toward Boyce. At this time Boyce drew his pistol from the scabbard. Parsons halted and asked him if he drew his "six shooter" on him. Boyce said "No Edwin I do not draw my pistol on you" and immediately put his pistol back in the scabbard. Parsons now appeared very angry, looking around him as if seeking something with which to fight, in the search he circled the yard, going near the "woodpile" as if hunting for an axe, came back near Boyce and was approaching a cabin in which they kept a gun when Boyce told him several times to stop, to which he Edwin paid no attention and as he went to enter said cabin Boyce shot him. 

It was proven that Edwin Parsons did promise to do the work about which he gave Boyce the lie. It was proven that Edwin Parsons was known to be a dangerous man when enraged. One witness testified that Parsons once attempted to kill him with an ax and no doubt would have done so had he not been prevented. He further then stated that he had known the said Edwin Parsons some twelve or fifteen years and always considered him dangerous when angry.

The above is about the evidence in substance given in the case against Boyce.

Boyce was tried before a committing court and gave bond to appear at the next term of the District Court which convenes in this County. Edwin Parsons is very near well of the wound inflicted by Boyce.
