Personally appeared before me J Westly Carpenter who upon oath says - that on the night of the 24th of September 1867 - i was with Dr Hunsaker at Mr. J.J. Woodsons store in the town of Crockett County and State above mentioned while Dr Hunsaker was organizing his guard, I heard Dr. Hunsaker tell his guard to interfere with no citizen white or black or molesting property, that they were organized for his protection and that if they did anything wrong for which they had not order that he would hold them responsible, I was with Dr Hunsaker and his guard until about ½ past 3,o'clock in the morning of the 25th Sept. I did not see the Doctor drink any liquor at any time that I was with him - nor did I see any intoxicating spirits in his party that night. The Doctor was not drunk nor do I think him at all under the influence of intoxicating drinks. There was considerable excitement but the Doctor never appeared to be excited. The guard arrested
