Personally appeared before me the undersigned authority - who on oath says that I was present when Dr Hunsaker organized his guard on the evening of the 24th Sept 1867-and was with him until about 03 oclock on the morning of the 25 Sept, 1867--and I farther state that Dr Hunsaker was not drunk nor under the influence of intoxicating liquors, sufficiently to incapacitate him for the discharge of his duties - I farther state that he drank no liquors that day or night or had any intoxicating liquors with him to the best of my knowledge that the said Hunsaker was in the discharge of his duties, that Miller was arrested, and that the guard were intimidated and over armed by the citizens of Crockett, a good many of whom were armed - that Dr Hunsaker nor his guard committed no violence upon any citizen or property of said town of Crockett, but simply acted on the defensive - There was firing of guns and pistols about 1,o'clock that night, said arms were fired by the citizens, who were on the north side of the square-fired in a southern direction as I saw the blaze and heard the reports [[strikethrough]]I was not over[[/strikethrough]]
