Respectfully referred to Chas. A. Vernou Genl & A.A.A.Genl Austin Tx the within appeal of Mr. Brewer by his Attys.

The evidence in this case is conclusive that Capt Miller settled on the basis of $200, & 300 bush of corn also that the corn had never been turned over to the freedmen.  The defdt's failed to prove that any other arrangements had ever been made.  Their only claim was that the enclosed reciept made a final settlement.  Circumstantial evidence is very strong that Capt Miller supposed
