Sir:

I have the honor to report that on Wednesday the 5th inst a freedman named Sam Robinson was shot and mortally wounded in the public square of Waco by a white man named E.M. [[Tally? Sally?]] a notorious desperado who has already killed three men in this County.

He was arrested by the civil authorities and turned over to me for safe keeping; on the 7 he was examined before the County Judge and released on bail;

Before Tally shot the freedman he came (in answer to a summons in regard to a debt due the man shot) into my office with two white men armed with bowies & six shooters leaving a mexican outside the door also armed; while in the office, and during my absence he abused my clerk and the F.M. using insulting and threatining language towards them and all the time cursing and talking in a very loud and boisterous manner; shortly after he left I came in and was informed of his conduct and was told he said he would kill me. I at once made up my mind to arrest him but before I could do so he had shot the freedman.

In view of the facts above stated I arrested Tally as soon as the Sheriff released him. I also arrested one of his confederates named Bill Smith both of whom I ironed and confined until the 8th inst when I released them takeing a bond from each Tally in the sum of $2000, and Smith $1000, binding them to keep the peace one year.

My action in the case is respectfully submitted for the approval of the Bvt Major Genl Commanding
