W. G. Porter being sworn testifies as follows (to wit)

On Sunday the 1st day of March 1865 at Dangerfield, Titus County, Texas.  I was there, on the north side of the public square I saw this gentleman (deseased) come in town on a buggy accompanied by a lady. They drove up to the Hotel, the deseased after a [[strikethrough]] while [[/strikethrough]] short time, came down from the hotel to where I was standing with several other gentlemen at the time. He came up and spoke to the crowd who were with me, the was dressed in a black cloth coat, black hat, pants were striped cashmere, cloth gater shoes, Mr. White Sheriff Mr. Webb & Chambers & Mr. Morris were of the party with me. The deceased spoke to us generally.  He remarked, I have come down to see you, come let us go and take a drink. Mr. White Chambers & Webb went into the saloon of Mr. Webb with the deseased, Mr. Morris and myself remained outside, about that time Mr. Morris walked from where he were sitting & I got up and went to the door of Webbs saloon, and stopped there, the deseased asked me to take a drink, I declined and asked him to excuse me. He then asked if the crowd had drunk; they told him they had, all drunk but him.  he then passed his glass to Webb & asked him to fix him up a drink.  After the drink was fixed the deseased took his gulp, and after talking, he drank. He then called for cigars, Webb said he had none, we all came out of the saloon together.  I took a seat out side & about that time I recognized Mr. White - the deseased left the platform. Mr. White remained north me, the deseased walked down on the east
