and I would hold him until a warrant could be issued - If not mistaken, Justice Metz was in church when called upon to issue the same.  It was done, not however on the usual form, but read "To bring the body of E C Powell before the aforesaid named Justice" (not, "or any other Justice for the county",) "instanter"

After issuing the warrant, he left.  I was informed for the Country. - The only charge thus far made, was for Arson, and the arrest was accordingly made under the said warrant, the officer permitting Powell to have a guard, upon his praying for the same, thus keeping him from Jail. - On Monday at the trial, the Dist Atty appeared for the State, assisted by a counsel employed by parties to me unknown - On going into trial, the warrant (copy enclosed) was presented, and the state illiberally stood upon his right to try the second charge first, notwithstanding the Dist Atty was notified that the prisoner came prepared to meet the charge of Arson only - Justice Metz stated he had destroyed the original warrant issued on Sunday - The whole trial was a persecution and showed conclusively a determination of the Dist Atty to convict, even after an "Alibi" had been clearly proved - The Justice invited objections of the prisoners Attorney, and inferred that they should be put on record. The utmost latitude was given to the [[?]] prosecution in the
