Thursday night to Mrs Curries with his friend Key (alias Planter) where he was told he could be entertained no longer - He went to the Hancock House and got supper - was not permitted to stay - from there to Kulows and from thence to Thatchers where he staid all night - Key his confederate, stole the money and the prisoner went the next morning a mile and a half in the country where they divided it. I hold him in a bond of $500."  

The evidence here adduced, let along the manner of conducting the prosecution, prove the Dist Attorney D W Harcourt to be totally incompetent and unfit to fill the position he occupies, and I would therefore respectfully ask his removal. The Magistrate is a superannuated old gentlemen, means well but knows no more about law than the dist Attorney. Doubtless the interests of the country would be served were he laid on the shelf, though I know of no one to take either his or the Dist Attorneys place.S.246. 

I would further ask for information whether it is not incumbent upon me to institute a suit against the Dist Attorney under Par IIII of the Civil Rights Bill. My action in the premises emanated from the conviction that Mr Powell was arrested without warrant, because of the reports in circulation referred to - not in any spirit of insubordination.
