Testimony, taken before George Metz Justice of the Peace in and for Colorado County State of Texas on the 29th of June 1868 at Columbus in said County upon an Examination of E C Powell then made before George Metz upon the charge of Arson, and Theft and Arson committed by him the said E.C Powell in said County on the 27th of June 1868.

Upon the defendant being arraigned for trial upon the charge of Theft in the sworn warrant, the defendants counsel moved to quash the warrant because the affidavit and warrant contained two distinct offences; the charge of Arson and Larceny which motion was over ruled by the Court - The Court then proceeded to the trial upon the charge of Theft - The witnesses in the case being sworn, were placed in the charge of the Constable.
