I saw him on friday night of the fire at 1/4 after 11 oclock a Hamiltons Jewelry store in company with Dave Townsend a freedman_ They were talking but I could not distinguish what was said.- This was the first time I had seen him that night_ Saw no one else about there_ After I had passed them, he (the prisoner) called me back and asked me what I thought of his success in getting up a school_ I did not speak with him more than 3 or 4 minutes_ I asked to be excused_ Townsend then left and the prisoner said he would go to Mr Thatchers_ Saw nothing more of Townsend. Cant say which way he went_ Saw neither of these parties any more that night.- I am town Constable_ I examined some three or four persons and found some boxes of Caps_ and a box of sardines in possession of Larkin Lewis which he said was given him by Mr Smith.

Have not see planter, since seeing him at the saloon_ I arrived at the fire about 2 oclock - saw a great many persons there_ Among whom several I recognized - I [[strikethrough]] no [[/strikethrough]] know of no act to implicate the prisoner for theft in my estimation_ Never saw the prisoner before a week ago_ He is a new comer never saw him with any baggage  He told me that he was a newspaper Correspondent_ [[strikethrough]] Never saw him with any baggage_ ordinarily [[/strikethrough]] but a newspaper, ordinarily a Correspondent for a newspaper would be supplied with some baggage_ He told me that he had come from Richmond
