Mr JJ Smith being duly sworn testified as follows;  I live in town south of most were the fire occurred - I have not seen Key in years - I saw no one driving a wagon the night of the fire - If I had have seen Key, I would have known him - I was at the fire - I went home immediately after the fire -

Henry Tracy being
duly sworn testifies as follows,  

I live in the Country about 2 1/2 miles south west of here - I was in town the night of the fire - I was acting as Jailer at the time.  

I was at the fire - The first time I saw the prisoner to know him was the night of his arrest -  I locked him up in Jail - I went to the Jail after the fire - I can't say that I know any fact or circumstance that would in any way implicate the prisoner of the charge preferred against him; in my opinion.

Mr Key being

Duly sworn testified as follows:  

I saw Mr. Key in company with the prisoner at my house on friday night before the fire - He remained at my house about 1/2 an hour - They came towards the Court House when they left my house - They had no
