Witness for defence,
Mr. Holmes being duly sworn testifies as follows: - I know one John Key. I suppose to be the same man in question.  I have known him for nine years - He has the character of being an honest man.

He was here the night of the fire - He staid at my house - He came there about sundown - He had a wagon - an open top one - with two bay horses hitched to it - He said he came for goods.  I expected him to eat supper at my house, but he did not.

He staid at my house that night.  His wagon and horses staid near my house that night. - My home is nearly due north of where the fire occurred, near the Depot, about 200 yards off - I went to the fire that night - Mr. Kay went to the fire but he did not go with me - Mr. Kay wore a flat brimmed hat, rather on the Mexican style of hats - The prisoner & Mr. Key & Mr. Miller called at my house the Monday night before the fire - I saw the prisoner near the railroad close to my house about 8 or 9 oclock Saturday morning after the fire - Mr. Key brought his wagon to my house about 7 oclock - It was there when the fire broke out, and it was there the next morning - Mr. Key was
