Lieutenant,

In reply to the Endorsement on the Affidavit of J M Beavers and others, asking for a report, I have the following statement to make, -

On Thursday the 4th day of June 1868, the County Court being in Session, business on the Civil and Criminal Docket was suspended and, his Honour Judge Allen was sitting as a Committing Court in the case of "The State of Texas against Antone Pohl" for Embezlements.  The Court adjourned about 12 O,Clock to meet again at 2 O,clock  I as sheriff, waiting upon said Court, walked into the Court room and, found J M Beavers Esqr on the Judges Bench_ Justin Beavers, asked me to bring out the Prisoners, Weaver and others_ I told him privately, that it was no use to bring Weaver out, for if he granted him bail, I should not obey his order for bail, but should put the Prisoner Weaver in the County Jail again under orders from Bvt Maj Genl Reynolds Comdg Dist Texas at Austin Texas_ Said orders holding
